What is a Gestational Carrier Agreement!?
Once all the parties agree to work together in a gestational surrogacy arrangement, the legal team chosen by the intended parents and the gestational carrier will draft and review a Gestational Carrier Agreement. This Agreement is a lengthy contract that all parties enter into prior to an embryo transfer.
Universal Surrogacy Services will provide the legal team with a detailed outline of all items that should be address in the Gestational Agreement. All of these items have been previously discussed and negotiated prior to initiating the Gestational Carrier Agreement.
The Gestational Carrier Agreement addresses the following:
- Gestational surrogate’s medical insurance situation
- Intended parents’ financial obligations
- Selective reduction & termination of a pregnancy
- Pregnancy prohibitions
- Lost wages and child-care in the event of bedrest and appointments associated with the gestational surrogacy arrangement
- And many, many more items.
The Gestational Carrier Agreement is also typically used in the legal process to establish parentage for the intended parents (most states have a legal protocol to establish parentage for the intended parents prior to the birth of the child).
Once the Gestational Carrier Agreement is approved and signed by all Parties, the legal team involved will send a Legal Clearance to the intended parents’ IVF physician. This Legal Clearance gives IVF physician the green light to initiate the IVF process for the intended parents and gestational surrogate. Next step is preparing for the embryo transfer!!
